1. Acceptance of Terms

By accessing or using ASI:One ("Service"), including our website, web application, mobile applications, and AI services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Fetch AI Inc, a Delaware corporation ("Company," "we," "us," or "our").

2. Eligibility

To use the Service, you must:

• Be at least 16 years old
• Be capable of forming a binding contract with us
• Not be barred from using the Service under applicable law
• Not have been previously suspended or removed from the Service

If you are accepting these Terms on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

ASI:One is an Artificial Social Intelligence platform that provides personalized AI assistants. Your AI learns from your interactions, represents you authentically, and can communicate with other users' AIs to help coordinate plans, maintain relationships, and manage your digital presence. Your AI is your digital partner—it works with you to enhance your life, not replace you.

4. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Your AI and Content

Your Content

You retain ownership of any content you provide to the Service, including information you share with your AI. By providing content, you grant us a license to use, process, and store that content to provide and improve the Service.

AI Personalization

Your AI learns from your interactions to provide personalized responses. You are responsible for the information you share with your AI and how your AI is configured to interact with others.

AI-to-AI Communication

Your AI may communicate with other users' AIs as part of the Service. When you enable this feature, you consent to your AI sharing relevant information with other AIs to facilitate connections, coordinate plans, and provide the Service functionality.

6. Community Guidelines

When using the Service, you agree to:

• Be respectful: Treat other users and their AIs with respect
• No discrimination: We do not tolerate racism, hateful language, or discrimination
• No illegal content: Do not post or share illegal content or use the Service for illegal purposes
• No harmful activity: Do not engage in activities that could harm others
• No impersonation: Do not impersonate others or misrepresent your identity
• No spam or abuse: Do not spam, harass, or abuse other users or the Service

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated means to access the Service without permission
• Transmit viruses, malware, or other harmful code
• Collect or harvest user information without consent
• Use the Service to generate content that violates third-party rights
• Circumvent any access controls or usage limits

8. Acceptable Use and AI Safety

ASI:One uses artificial intelligence models to provide its services. You are responsible for how you use the Service and for any content you create, share, or cause to be generated through the Service. You agree to use the Service in compliance with all applicable laws and regulations. The following rules apply to all users without exception.

Prohibited Content and Activities

You may not use the Service to create, share, solicit, or distribute content or engage in activities that:

• Violate any law or regulation in your jurisdiction, including laws related to fraud, consumer protection, privacy, intellectual property, anti-money laundering, economic sanctions, or export controls, or access the Service while you are a sanctioned or denied party as described in the Export Controls and Trade Compliance section below
• Promote or facilitate violence or terrorism, including inciting, glorifying, or providing material support for violent extremism, terrorism, or hateful behavior
• Exploit, endanger, or sexualize minors in any way, including generating, distributing, or soliciting child sexual abuse material (CSAM), grooming, or exposing minors to age-inappropriate content. Any content involving the sexual exploitation of minors will result in immediate and permanent account termination and mandatory reporting to the National Center for Missing and Exploited Children (NCMEC) and applicable law enforcement authorities
• Generate, request, or distribute nude, sexually explicit, or intimate images of any individual using AI models or any other feature of the Service, whether the subject is real or fictional, and regardless of whether the individual depicted has consented. This includes but is not limited to deepfakes, AI-generated nudity, undressing or clothing removal, and any manipulation of images to create sexual or intimate content. Generating nude or sexually explicit images of any person may violate state and federal laws and will result in account termination
• Harass, bully, threaten, or defame other individuals, or coordinate campaigns of intimidation or abuse
• Promote self-harm, suicide, or disordered eating, including glamorizing, instructing, or facilitating any form of self-injury
• Generate or distribute hate speech or discriminatory content targeting individuals or groups based on race, ethnicity, religion, national origin, gender, sexual orientation, disability, or any other protected characteristic
• Create or spread misinformation, including fabricating false news, generating deepfakes, or producing deceptive content designed to mislead others about facts, events, or the identity of its source
• Facilitate fraud, scams, or phishing, including creating falsified documents, fake identities, counterfeit goods, or deceptive schemes designed to cause financial or psychological harm
• Develop, design, or procure weapons or dangerous materials, including conventional weapons, explosives, or chemical, biological, radiological, or nuclear (CBRN) agents
• Compromise computer systems, networks, or infrastructure, including developing malware, conducting unauthorized access, exploiting vulnerabilities, or disrupting critical infrastructure such as power grids, healthcare systems, or financial networks
• Violate the privacy or identity rights of others, including unauthorized collection of personal information, non-consensual surveillance, biometric profiling, or impersonation of real individuals
• Undermine democratic or civic processes, including generating deceptive political content, suppressing voter participation, or interfering with elections
• Engage in or facilitate the acquisition or exchange of illegal goods or services, including controlled substances, human trafficking, or unlicensed financial services

AI Model Usage and Limitations

The AI features of the Service are powered by third-party language models and proprietary technology. When using AI features, you acknowledge and agree that:

• AI-generated outputs may be inaccurate, incomplete, or biased. You are responsible for reviewing and verifying any AI-generated content before relying on it
• AI outputs do not constitute professional advice. You must not rely on the Service as a substitute for licensed professional guidance in areas such as medicine, law, finance, tax, or mental health
• You may not use AI features to generate content that would violate the Prohibited Content and Activities listed above, including but not limited to sexually explicit imagery, nude or intimate images of any person, or content that exploits minors
• You may not upload, submit, or provide images of other individuals to AI features for the purpose of generating manipulated, sexualized, or otherwise harmful depictions of those individuals
• You may not attempt to circumvent, bypass, or override the safety measures, content filters, or usage restrictions built into the Service or its underlying AI models
• You are responsible for any actions taken by your AI on your behalf, including communications with other users' AIs, content generation, and any automated tasks
• You may not use the Service to train, distill, or extract the weights, parameters, or capabilities of the underlying AI models without our express written permission
• When sharing AI-generated content outside the Service, you should not misrepresent it as being created entirely by a human

Enforcement and Remediation

We take the safety of our users and the integrity of our platform seriously. To protect our community, we employ a combination of automated systems and human review to detect and address violations of these terms. Our enforcement actions may include, at our sole discretion:

• Issuing warnings or requiring acknowledgment of policy violations
• Temporarily restricting or suspending access to specific features or the entire Service
• Permanently terminating your account
• Removing, filtering, or modifying content that violates these terms
• Reporting illegal activity to the relevant law enforcement authorities, including reports of child sexual abuse material to the National Center for Missing and Exploited Children (NCMEC) or equivalent authorities in your jurisdiction
• Cooperating with law enforcement investigations where required by law or where we believe there is an imminent risk of harm
• Pursuing legal remedies, including claims for damages and injunctive relief

Mandatory Enforcement for Severe Violations

Certain violations require immediate action and are not subject to warnings or graduated enforcement. The following will result in immediate and permanent account termination:

• Any content that sexually exploits, depicts, or endangers minors, including AI-generated content. We are legally obligated to report such content to the National Center for Missing and Exploited Children (NCMEC) and will cooperate fully with law enforcement investigations
• Using the Service to generate nude, sexually explicit, or intimate imagery of any individual, whether through AI image generation, image manipulation, or any other means
• Using the Service to facilitate, plan, or carry out acts of violence, terrorism, human trafficking, or other serious criminal activity
• Repeated or egregious violations of the Prohibited Content and Activities listed above after prior notice

We reserve the right to preserve and disclose account information and content as required by law or when we have a good-faith belief that such action is necessary to comply with legal process, protect the safety of any person, or prevent death or serious bodily harm.

If you believe your account has been restricted in error, you may contact us at legal@fetch.ai to request a review. We will investigate and respond within a reasonable timeframe.

Reporting Violations

If you encounter content or behavior on the Service that you believe violates these terms or applicable law, please report it to legal@fetch.ai. We review all reports and take appropriate action in accordance with these terms and applicable law.

9. Subscription and Payments

Some features of the Service may require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may change with reasonable notice
• Refunds are provided in accordance with our refund policy

You are responsible for any applicable taxes associated with your use of the Service.

10. Intellectual Property

The Service, including its design, features, content, and technology, is owned by Fetch AI Inc and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express permission.

11. Third-Party Services

Google API Services

The Service integrates with various Google APIs to enhance your AI's capabilities, including Google Calendar, Gmail, and Google Contacts (People API). When you connect these services:

• You authorize your AI to access information from your connected Google services to perform tasks on your behalf
• Data from Google services is used only to provide the specific AI features you request and is not stored beyond what is necessary for those features
• You may revoke access at any time through your Google Account settings

Your use of Google API Services through ASI:One is also subject to Google's Terms of Service and Privacy Policy.

Google reCAPTCHA

This site uses Google reCAPTCHA to protect against spam and abuse. By using the Service, you agree to comply with Google's Terms of Service and acknowledge Google's Privacy Policy with respect to reCAPTCHA.

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party sites. Your use of third-party services is at your own risk.

12. Cryptocurrency Wallet Services

The Service may include cryptocurrency wallet functionality. If you use wallet features:

• You are solely responsible for securing your wallet credentials and private keys
• Cryptocurrency transactions are irreversible—verify all details before transacting
• We are not liable for lost, stolen, or misdirected digital assets
• You are responsible for understanding and complying with cryptocurrency regulations in your jurisdiction
• You are responsible for reporting and paying applicable taxes on cryptocurrency transactions

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any AI-generated content will be error-free or appropriate for your needs
• The Service will meet your requirements

Your AI may make mistakes. You should verify important information independently. AI responses should not be relied upon for legal, medical, financial, or other professional advice.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCH AI INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fetch AI Inc and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, though certain provisions of these Terms will survive termination.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

18. Data Protection and Privacy

Your privacy is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information and describes your data protection rights and choices, including your control over whether your data is used to train AI models.

The data controller responsible for your personal information is Fetch AI Inc, a Delaware corporation with its headquarters at 99 Monroe Ave NW, Grand Rapids, MI 49503, United States. If you are in the United Kingdom, our representative for the purposes of Article 27 of the UK General Data Protection Regulation (UK GDPR) is uVue Ltd, 18 Langton Place, Bury St Edmunds, Suffolk, IP33 1NE, United Kingdom, and you have the right to lodge a complaint with the Information Commissioner's Office (ICO).

19. Export Controls and Trade Compliance

The Service, including the underlying artificial intelligence models and their outputs, is subject to United States export control and economic sanctions laws, and may be subject to the export or import laws of other jurisdictions. By accessing or using the Service, you make the following representations and agree to the following commitments.

Sanctions and Denied-Party Representations

You represent and warrant that:

• You are not located in, ordinarily resident in, or organized under the laws of any country or region subject to comprehensive economic sanctions or embargoes administered by the United States, the United Nations, the United Kingdom, or the European Union
• You are not identified on, or owned or controlled by a party identified on, any restricted or denied-party list maintained by the United States (including the Office of Foreign Assets Control Specially Designated Nationals and Blocked Persons List and the Commerce Department Denied Persons, Entity, or Unverified Lists), the United Nations, the United Kingdom, or the European Union
• You are not acting on behalf of, or for the benefit of, any such sanctioned country, region, or party

Export-Control and End-Use Commitments

• You will not export, re-export, transfer, or otherwise make available access to the Service, the AI models, or their outputs, directly or indirectly, in violation of the US Export Administration Regulations, US sanctions administered by the Office of Foreign Assets Control, or the equivalent export-control and sanctions regimes of the United Kingdom, the European Union, or other applicable jurisdictions
• You will not use the Service for any prohibited end-use under applicable export-control law, including the development, design, production, or use of nuclear, chemical, or biological weapons, missiles, or other weapons of mass destruction
• You are responsible for complying with all applicable trade-control laws in every jurisdiction from which you access the Service

Suspension and Termination for Trade-Control Reasons

We may restrict, suspend, or terminate your access to the Service, in whole or in part and without prior notice, where we reasonably believe that continued access would violate, or create a risk of violating, applicable export-control or sanctions laws, or where required to comply with a legal or regulatory obligation. We may also use automated and manual screening to detect access from sanctioned jurisdictions or by denied parties.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales.
